GENERAL TERMS AND CONDITIONS OF THE OLABELA.PL ONLINE SHOP

1. DEFINITIONS

Business Days - Days from Monday to Friday, except public holidays.

Account - governed by separate rules unpaid store function (a service provided electronically) through which the buyer can create your individual account shop.

Consumer - Consumer within the meaning of the Civil Law.

Buyer - every entity buyer in the store.

Regulations - these regulations.

3. PURCHASES IN STOCK

1. The prices of goods visible in the store are the total prices of the goods, including VAT.
2. The seller notes that the total price of the order specified in the shop together: the price of the goods and, if applicable in a particular case, the cost of delivery.
3. The product selected for purchase should be added to the cart in the store. Then the buyer selects available method of delivery of the goods and the method of payment for the order and also provides the data needed to complete the order.
4. The order will be made after confirmation of its contents and taking over the rules by the buyers.
5. The order is identical to the conclusion of a purchase contract between the buyer and the seller.
6. At the latest upon delivery, the seller will confirm the sale in the form of an e-mail and PDF invoice sent to the e-mail address provided by the buyer.
7. The buyer must register in the store to make purchases. 

4. PAYMENTS

The order can be paid according to the choice of the buyer:

Through the payment platform: PayPal, EURO transfer. 

5. CONCLUSION OF CONTRACT


1. The term of the contract is specified in the shop.
2. The buyer has to pay the order in advance, the seller will process the order after the payment.
3. Where in the same order buyer purchased goods with different time of delivery, the order will be processed for the longest time in the right product.
4. Goods purchased in the store are delivered depending on which delivery type the buyer has chosen (at this time: DPD).
5. In the absence of payment of the order within 7 days of its submission, the seller has the right to cancel the order without contacting the buyer. 

6. If the Customer fails to collect the parcel and the parcel is returned to the Seller, the Seller reserves that the parcel will be re-shipped after the Customer covers the cost of returning the parcel and the cost of re-sending. If the Customer requests a refund (without re-sending the package), the Seller will reduce the refund amount by the shipping costs and returning the package to the Seller.

7. Material of a given type (one pattern / color) ordered in quantities exceeding 5m may be delivered in more than one piece. Cuts longer than 3 meters may not be continuous or may have small factory defects. If the defect is in the middle of your cut, we'll add in a few inches to make up the difference.

8. If you have a EU VAT number and want to buy products without VAT, please let us know before paying the order (choose bank transfer). We will modify the value of the order and then pay for it.

9. By accepting this terms and conditions, the customer agrees to receive an electronic invoice in PDF form and expresses his will to receive such an invoice to the e-mail address provided during registration.

6. RIGHT OF WITHDRAWAL

1. The consumer has the right to withdraw from the contract with the seller through the store within 14 days without giving any reason.
2. The deadline to withdraw from the contract will expire after 14 days from the day the buyer received the parcel.
3. For the consumer, the exercise of the right of withdrawal must inform the seller using the data given in § 2 of their decision to withdraw from the contract by a clear statement (eg a letter sent by mail or information sent by e-mail).
4. The consumer may use the model withdrawal form found at the end of the regulations, but it is not mandatory.

Consequences of withdrawal

5. In the event of termination of the contract Seller Consumer will receive all payments received from him, including the cost of delivery of goods (excluding the additional costs resulting from the procedure chosen by the Consumer Supply other than the cheapest regular delivery offered by the Seller), immediately and in any case not later than 14 days from the date on which the seller informs the decision on the implementation of the consumer withdrawal right.
7. The seller may refuse the refund until receipt of the goods or you have evidence of his references to him, depending on which event occurs first.
8. The seller asks to return the goods to the address: ul. Tyska 15g, 43-176 Gostyń immediately, and in any case no later than 14 days from the date on which the consumer informs the seller of the contract of sale. The deadline is met when consumers send the goods back before the deadline of 14 days.
9. The consumer bears the direct costs of the return.
10. The consumer has been liable only for a possible loss in value of the goods resulting from the use of it in a different way than was necessary to create the nature, condition and functioning of the goods.
11. If, due to their nature, the goods can not be sent by post to normal mode, the consumer will bear the immediate costs of returning the goods. The estimated amount of these costs consumers will be informed by the seller in the description of the goods in the store or when ordering.
12. Refunds in EURO, USD or GBP can only be made to a PayPal account.

13. The store reimburses 80% of the price of the returned fabric (fabric cut from a beam).

14. Digital products (sewing patterns in PDF format) are not subject to complaints and returns.

7. COMPLAINTS

1. In the case of a defect of the goods, the buyer has the opportunity to complaint the defective goods on the basis of the guarantee or guarantee of the Civil Law. Attention: No claims can be entertained or exchanges made once the material has been cut. The left side of the fabric is not subject to complaint. The error limit for cut material is +/- 2-5 cm.
2. With the guarantee, the buyer may, under the terms and conditions of the Civil Law:
a) Submit a price reduction statement,
b) In the case of a defect - Declaration to withdraw from the contract,
c) Demand for replacement of faultless items,
d) Request the removal of the defect.
3. The seller asks to submit a claim based on the guarantee to the postal address or electronic address specified in § 2 of the order.
4. If it turns out that in order to settle the complaint, the advertised goods are to be delivered to the seller, the buyer is obliged to deliver the goods, in the case of the consumer at the expense of the seller, to the address ul. Tyska 15g, 43-176 Gostyń.
5. If the product has been granted an additional warranty, you will find information about it and its terms in the product description in the store.
6. Complaints concerning the operation of the business should be directed to the e-mail address indicated in § 2 of the regulations.7. The seller will review the complaint within 14 days.

8. PERSONAL DATA

1. The administrator of the personal data that allows the buyer to make the purchase is the seller.
2. The personal data of the purchaser are processed on the basis of a contract and its implementation in accordance with the principles of the General Regulation of the European Parliament and of the Council (EU) on Data Protection (GDPR). For detailed information about data processing by the seller, see the Privacy Statement published in the Store.

9. DISCLAIMER

1. It is forbidden to provide illegal contents to the buyer.
2. Each order placed in the store is a separate purchase contract and requires separate acceptance of the terms. The contract is concluded in time and for the purpose of the contract.
3. Contracts concluded on the basis of these regulations will be concluded in Polish.
4. In the event of a possible dispute with the buyer who is not a consumer, the competent court is the court having jurisdiction over the location of the seller.
5. None of the provisions of this Regulation excludes or restricts the rights of the consumer arising from the statutory provisions.
